Refund Policy of Milna Beauty Website

ARTICLE 1. PARTIES
This refund policy applies between Milna Beauty, a sole proprietorship registered in  France Commercial Registry under number 94067780000010, headquartered in France, VAT not applicable, Article 293B of CGI, hereinafter referred to as "the Publisher," and any person, whether natural or legal, private or public law, registered on the Website to purchase a Product, hereinafter referred to as "the Customer."

ARTICLE 2. DEFINITIONS

  • "Customer": Any natural or legal person, whether private or public, registered on the Website.

  • "Website Content": Any elements published on the Website, whether protected by intellectual property rights or not, including texts, images, designs, presentations, videos, diagrams, structures, databases, or software.

  • "Publisher": Milna Beauty, a sole proprietorship acting as the editor of the Website.

  • "User": Any natural or legal person, whether private or public, connecting to the Website.

  • "Product": Any goods sold on the Website by the Publisher to Customers.

  • "Website": The website accessible at the URL Milna Beauty, along with its sub-sites, mirror sites, portals, and variations of related URLs.

ARTICLE 3. SCOPE OF APPLICATION
The Website is free and accessible to any User. Browsing the Website implies the acceptance of these general terms and conditions by the User. Simply connecting to the Website by any means, including through a bot or a browser, will constitute full and unconditional acceptance of these terms and conditions. During registration on the Website, this acceptance will be confirmed by checking the corresponding box.

The User acknowledges having fully read and accepted these terms without restriction.

Checking the above box is considered equivalent to a handwritten signature by the User. The User recognizes the evidentiary value of the Publisher's automatic recording systems and waives the right to contest them in the event of a dispute, unless they provide evidence to the contrary.

These general terms and conditions apply to the relationship between the parties, excluding all other terms, especially those of the User.

Acceptance of these general terms and conditions assumes that the Users have the legal capacity to do so, or have authorization from a tutor or curator if they are unable, from a legal representative if they are minors, or have a mandate if they act on behalf of a legal entity.

ARTICLE 4. PURPOSE OF THE WEBSITE
The Website is designed for selling Products to Customers.

ARTICLE 5. ORDER PROCESS
5.1 Order
To place an order, Users can select one or more Products and add them to their cart. Product availability is indicated on the Website in the product description. When their order is complete, they can access their cart by clicking on the designated button.

5.2 Validation of the Order by the User
By reviewing their cart, Users will have the ability to verify the number and nature of the Products they have selected, check the unit price, and the total price. They can remove one or more Products from their cart.

If the order is satisfactory, Users can validate it. They will then be redirected to a form where they can either enter their login details if they already have an account or register by filling in the necessary personal information.

5.3 Payment by the Customer
Once logged in or after completing the registration form, Customers will be prompted to verify or modify their delivery and billing details, then proceed with the payment through a secure payment interface marked "order with payment obligation" or similar.

5.4 Confirmation of Order by the Publisher
Once the payment is received by the Publisher, they commit to acknowledging receipt of the payment via electronic means within a maximum of 24 hours. Within the same timeframe, the Publisher will send the Customer an email confirming the order, including all relevant details.

ARTICLE 6. PRICE - PAYMENT
6.1 Price
The applicable prices are those displayed on the Website at the time of the order. These prices may be modified by the Publisher at any time. Prices displayed are valid only on the day of the order and do not apply for the future.

Prices on the Website are in euros, including all taxes, excluding delivery costs.

6.2 Payment Methods
The Customer may pay using PayPal, Stripe, Amazon Pay, or Google Pay.

For card payments, the Publisher does not have access to any payment data. Payment is processed directly by the bank.

In the case of payment by mandate, check, or bank transfer, delivery times start only after payment is received by the Publisher.

6.3 Invoicing
The Publisher will send or make available to the Customer an electronic invoice after each payment. The Customer expressly agrees to receive invoices electronically.

6.4 Non-payment
Payment dates cannot be postponed for any reason, including disputes.

Any unpaid amount will automatically incur late payment penalties at three times the legal interest rate, without affecting the principal sum due.

Additionally, late payment will result in collection fees of 40 euros and immediate payment of any remaining amounts, plus a 20% penalty fee, and the possibility for the Publisher to terminate the contract unilaterally due to the Customer's fault.

6.5 Retention of Ownership
The Products remain the property of the Publisher until full payment is made.

ARTICLE 7. COMPLAINTS - WITHDRAWAL - WARRANTY
7.1 Customer Service

7.2 Right of Withdrawal – Distance Selling
This section 7.2 applies to Customers who are consumers according to the French Consumer Code.

7.2.1 Conditions for Exercising the Right of Withdrawal
Under current distance selling legislation, the Customer has a fourteen-day period to withdraw without providing any reason and without penalty, except for return shipping costs if applicable.

The period starts either from the day the contract is concluded for services and/or digital content contracts, or from the day the Customer or a third party, other than the carrier, receives the goods for sales contracts.

The withdrawal notification must be sent to the Publisher using a clear statement, and the Publisher will acknowledge receipt via email as soon as possible.

7.2.2 Effects of the Right of Withdrawal
The Customer must return the products to the Publisher or a designated person within fourteen days of notifying the withdrawal decision.

Once the right of withdrawal is exercised, the Publisher must refund the Customer in full within fourteen days. If applicable, the Publisher can delay the refund until they receive the products or proof of shipment, whichever happens first.

7.2.3 Exclusions from the Right of Withdrawal
The right of withdrawal does not apply to certain contracts, including services performed before the end of the withdrawal period or goods made to the Customer’s specifications.

7.3 Resolution of Contract at Customer's Initiative
A consumer Customer can cancel the contract by registered letter with return receipt if the delivery is delayed by more than seven days. The Customer will be refunded all sums paid during the order.

7.4 Guarantees
7.4.1 Warranty for Apparent Defects
The Customer is responsible for inspecting the Product upon delivery. Any complaints must be made within three days of delivery.

7.4.2 Warranty for Hidden Defects
Consumers have a legal warranty against hidden defects for two years from the delivery of the Product.

ARTICLE 8. FINAL PROVISIONS
8.1 Applicable Law
These terms are governed by French law.

8.2 Modifications to the Terms
These terms may be modified at any time by the Publisher. The terms applicable to the Customer are those in effect at the time of their order or connection to the Website.

8.3 Disputes
In case of a dispute, the Customer may resort to mediation, and the Website provides a platform for online dispute resolution.

8.4 Severability
If any clause is found invalid, the other clauses will remain in effect.

8.5 No Waiver
Failure to exercise rights by the Publisher does not constitute a waiver of those rights.

8.6 Telemarketing
The Customer is informed that they may register on the do-not-call list at http://www.bloctel.gouv.fr/ 

8.7 Languages of the Terms
These terms are provided in English.

8.8 Abusive Clauses
These terms apply subject to compliance with mandatory provisions of the French Consumer Code regarding abusive clauses in contracts between professionals and consumers.
